Overview

Andrew serves as labor and employment counsel to employers across many industries. He has broad knowledge of the full range of employment laws and works with clients to find creative solutions to the most challenging workplace issues.

A significant portion of Andrew’s practice involves representing construction contractors on the unique labor and employment issues facing the industry, including compliance with prevailing wage laws and matters involving multi-employer defined benefit pension plans. He also has experience representing contractors in NLRB, Department of Labor, and OSHA proceedings.

Andrew represents employers in class action wage and hour litigation in federal and state courts and has defended class claims relating to independent contractor classification, off-the-clock work, and overtime regular rate issues. He also litigates employment discrimination and harassment claims in federal and state courts, as well as before the EEOC and other administrative agencies.

Andrew’s labor practice involves representing management in collective bargaining negotiations, labor arbitrations, and NLRB elections and unfair labor practice proceedings.

  • National manufacturing employer: Employment counsel to a diversified manufacturing company operating in multiple states across the U.S. Regularly provides counseling concerning hiring, discipline, terminations, discriminatory harassment reports and investigations, restrictive covenants, leave and accommodation issues, and other labor and employment matters.
  • Pharmaceutical industry employer: Enforced non-competition and confidentiality agreement in federal court to prevent a former executive from engaging in competitive employment and secured the return of confidential information.
  • Regional highway construction contractors: Represented contractors in False Claims Act litigation in federal court arising from alleged Davis-Bacon misclassification by subcontractor.
  • Regional highway construction contractor: Represented contractor in administrative proceedings before the Pennsylvania Department of Labor & Industry under the Pennsylvania Prevailing Wage Act.
  • Regional traffic control contractor: Represented contractor in class action lawsuit under the Pennsylvania Minimum Wage Act, claiming unpaid hours worked, including allegations that travel time to and from jobsites in company trucks with company equipment was compensable time.
  • National food industry employer: Labor and employment counsel to a food industry employer with several major brands. Regularly provides counseling concerning various labor and employment matters.
  • Regional food industry employer: Defended class and collective action claims involving alleged misclassification of route sales employees.
  • National food industry employer: Represented employer in NLRB election proceedings and related unfair labor practice proceedings.
  • Construction contractors’ bargaining association: Decades of successful representation of contractors’ association in collective bargaining and related matters.
