Overview

Austin represents businesses, individuals, and government entities and officials in litigation matters before administrative agencies and in state and federal courts.

He has extensive experience representing clients in appeals before the Pennsylvania Supreme Court, the Pennsylvania Commonwealth Court, the Pennsylvania Superior Court, and the Third Circuit Court of Appeals, as either parties to the appeal or amici curiae. Additionally, he frequently represents clients in matters before the Pennsylvania Commonwealth Court in its original jurisdiction.

Austin handles matters involving:

  • State and federal constitutional law, including declaratory judgment actions and Section 1983 actions
  • Emergency relief, including injunctions and stays pending appeal
  • Complex commercial and business disputes, including breach-of-contract actions, business torts, and disputes between partners or shareholders

He also frequently advises clients on Freedom of Information Act and Pennsylvania Right-to-Know Law requests.

Prior to joining McNees, Austin served for four years as a judicial law clerk in Pennsylvania’s trial and appellate courts. Immediately prior to joining McNees, he served as a clerk to Justice Sallie Updyke Mundy of the Supreme Court of Pennsylvania. Austin also previously served as a clerk to now President Judge Renee Cohn Jubelirer of the Commonwealth Court and to Judge Clyde W. Vedder of the Court of Common Pleas of York County.

Aside from his legal practice, Austin serves by appointment of the Pennsylvania Supreme Court as a member of the Pennsylvania Appellate Court Procedural Rules Committee, where he assists with refining and updating the Pennsylvania Rules of Appellate Procedure.
