Benjamin represents a variety of public and private clients, including owners, general contractors, subcontractors, municipal authorities, school districts, and private individuals. He advises on contract negotiation and project strategies, focusing on helping clients manage risk and resolve disputes across a wide range of project types.
Benjamin handles construction disputes and claims involving liens, payment delays, change orders, differing site conditions, project acceleration, resequencing, and inefficiencies. He also negotiates and advises on contracts and project strategies on the front end. His experience spans project types ranging from natural gas refineries, wastewater treatment plants, schools, churches, and commercial buildings to parking garages and residential homes.
Benjamin’s comfort handling matters from contract negotiation through initial dispute through trial stems from his representation of clients in federal and state courts across multiple jurisdictions, as well as through alternative dispute resolution such as arbitration and mediation.
In addition to being involved in industry groups, Benjamin also writes articles and presents seminars on relevant topics, such as strategies and pitfalls of contract negotiation.
Prior to joining McNees, Benjamin worked as a construction attorney at the Pittsburgh offices of a corporate and transportation law firm, where he maintained a construction and litigation practice, and an Am Law 200 civil defense litigation firm.
