Real estate financing requires an understanding of both the loan and the property securing it. Title matters, and existing leases and easements may affect the collateral. Development approvals or environmental conditions can also influence the transaction. We help clients identify those issues early and address them as part of the financing strategy.
We represent borrowers and lenders in acquisition financing, construction loans, and permanent financing. Our experience also includes commercial mortgages and private debt, as well as sale-leaseback transactions and leasehold financing. We advise on refinancing and loan modifications when a property or project requires a different capital structure.
Our attorneys negotiate loan and security documents and coordinate the due diligence needed to reach closing. We review title and survey matters, entity documents, and property agreements that may affect the lender’s security or the borrower’s plans for the asset.
