Utility Rates and Service Disputes

The cost and terms of utility service can influence where a business invests, how a facility operates, and whether expansion plans remain viable. We represent large industrial and institutional customers, municipal utilities, certain transmission-dependent utilities, and other service providers in the proceedings and negotiations that shape those decisions.

Our attorneys do more than respond to proposed rates or disputed charges. We help clients understand how tariffs, cost allocation, service classifications, and infrastructure obligations affect their current operations and assist with planning for the future. We then advocate for their interests before state utility commissions and, when transmission or wholesale market issues are involved, the Federal Energy Regulatory Commission.

Many utility issues develop before a formal case is filed. A new facility or expanded load may require a different service arrangement. A tariff interpretation may significantly change costs or reliability. Municipalities and providers may also need to reconsider rate design or service obligations as infrastructure needs evolve. We help clients address those questions early, negotiate workable terms, and prepare for a contested proceeding when necessary. We are also active in the PJM and MISO stakeholder processes on behalf of large customers, which can be another proactive avenue for addressing or resolving issues.

Because we work with both large energy users and certain service providers, we understand the operational and regulatory pressures affecting each side of the relationship. We serve clients across the country and coordinate with local counsel when state-specific requirements apply, while keeping the strategy focused on the client’s financial and commercial objectives.
