9:30 – 10:20 a.m. – Beyond the Boilerplate: Strategies for Construction Contracts and Risk Control
Speaker: Amanda Kraft
In this session, we will discuss common pitfalls in construction contract drafting and negotiation and explore beneficial project risk controls. We will explore key questions such as “What does ‘pay if paid’ vs ‘pay when paid’ mean?” and “When should retainage be paid?” The discussion will also cover the challenges that arise when you are “not allowed to make any changes” to a contract.

10:30 – 11:30 a.m. – Navigating Construction Disputes
Speakers: David Cole, Paul Rose, Jim Kutz, and Ashley Nichols Weber 
A foundational overview of the legal landscape in construction. We’ll demystify key concepts in construction litigation, including the essentials of bond claims, mechanics’ liens, the Maryland trust fund statute, and prompt payment. This session will also provide a brief look into unique challenges within the heavy highway context, such as “Remove and Replace” directives and latent defects.

11:40 a.m. – 12:30 p.m. – Labor and Employment Law in the Construction Industry 
Speakers: Andrew Levy and Derek Roussillon
In this fast-paced session, we will take a look at key labor and employment requirements applicable to contractors, including prevailing wage requirements on public works, wage and hour compliance, the state of affirmative action and DBE in the current administration, discrimination law updates, and more.
