Our focus

Disputes involving confidential information can move quickly, especially after an employee departure or a breakdown in a business relationship. Early decisions may determine whether valuable information remains protected and whether customer relationships are preserved.

We represent businesses seeking to enforce restrictive covenants, including non-competition, non-solicitation of customers and/or employees, and confidentiality/non-disclosure provisions. We also defend companies and individuals accused of violating them.

Our work includes trade secret claims, business divorce cases, and disputes over noncompete agreements. We also handle claims involving breach of non-solicitation and confidentiality obligations. These matters oftentimes also involve allegations of unfair competition or breach of fiduciary duty.

At the outset, we help clients determine whether the information at issue is legally protected and whether the agreement at issue is enforceable. We also assess what evidence will be needed to advance or defend against the claims and how quickly the matter may need to move.

When immediate harm is possible, and rights may be irretrievably lost, we pursue or defend temporary restraining orders and preliminary injunctions. We prepare the matter for an accelerated hearing while keeping the litigation strategy connected to the business concern behind the dispute.

These matters often overlap with employment law or broader commercial claims. When that happens, we bring the right attorneys into the strategy early, keeping in mind at all times the overall business objectives of our clients.

Some disputes can be resolved through negotiation. Others require litigation to protect the business. We help clients choose a path that fits the risk and the urgency of the situation.
