McNees 2018 Victory for Evangelical Community Hospital Affirmed on Appeal

HARRISBURG, Pa. – (June 29, 2020) The Litigation Practice Group at McNees Wallace & Nurick LLC successfully defended a $6.2 million claim against Union County, Pennsylvania medical facility, Evangelical Community Hospital, four individual physicians, and the Hospital’s former CEO. The case was brought by a physician who was suspended in 2012 and then reinstated with a proctoring requirement.
On June 25, 2020, a judge concluded that a lower court’s decision to grant the Defendants’ Motion for Judgment Notwithstanding the Verdict is correct and will stand. This is in response to the plaintiff’s appeal of the 2018 decision to grant the Judgment after a jury returned with a mixed verdict. As a result, all defendants have immunity from damages pursuant to the federal Healthcare Quality Improvement Act. The case was tried by Carol Steinour Young, Esq. and Dana Chilson, Esq. of McNees Wallace & Nurick LLC.
