Many businesses have struggled to determine whether a worker is an “employee” (who is subject to the minimum wage and overtime requirements of the Fair Labor Standards Act) or an “independent contractor” (who is not).  In the first week of January, the Department of Labor issued a long-awaited new rule attempting to provide clarity for businesses in drawing the line between employee and independent contractor. In this webinar, we will review the new rule and what is changing, discuss whether we believe it will survive following the departure of the Trump Administration, and identify other areas to watch as the Biden Administration begins.
