The Thorny Aspects of Wage & Hour Compliance

Employers remain exposed to potential significant liabilities associated with Department of Labor (DOL) investigations and private wage and hour lawsuits due to non-compliance with federal and state wage and hour laws.  This session will include discussion regarding some of the more important and thorny aspects of wage and hour compliance and provide practical guidance so that proactive employers can take the steps necessary to avoid hidden “traps” and common mistakes and pitfalls.  Topics for discussion will include the salary basis rule for exempt employees and permissible salary deductions, how to treat extra compensation (such as bonus, commissions, and shift differentials) for overtime purposes, how to maintain accurate work time records and avoid “off-the-clock” work, how to calculated overtime in certain special  circumstances (such as when an employee works at two different jobs at different pay rates in the same pay period), and when employee travel time must be recorded and paid as  compensable work time.  The status of pending federal and state wage and hour legislation will also be discussed.
