Donald J. McKay is Of Counsel in McNees’ Intellectual Property Law Group, where he helps clients protect and maximize the value of inventions, methods, systems, programs, business methods, and devices across mechanical, chemical, electrical, biotechnological, and computer/business method technologies. His practice includes patent and trademark prosecution, portfolio management, infringement investigations, licensing, and strategic counseling to protect and strengthen intellectual property assets.
With more than 20 years as a member of the Patent Bar and over 15 years as a member of the Pennsylvania Bar, Don has prosecuted a wide range of patents and hundreds of trademark applications.
Leveraging his deep understanding of the business world, Don guides clients through complex commercial and business matters, delivering legal solutions that blend creativity, innovation, and practicality. He manages the patent and trademark portfolios of some of Western Pennsylvania’s fastest-growing companies, helping businesses navigate regulatory requirements, litigation, and costly disputes, while mitigating risk.
His work spans entity formation, dispute resolution, commercial contract negotiation, shareholder and employment agreements, software licenses, and the procurement and enforcement of patents and trademarks. He also structures supplier, customer, and service agreements for engineering and industrial manufacturing clients, advising on liability allocation, warranties, indemnification, intellectual property rights, and regulatory compliance.
Before joining McNees, Don founded and managed a boutique business and intellectual property firm in Pittsburgh, earning a reputation for delivering individualized, commercially focused legal solutions tailored to each client’s needs.
He is admitted to practice in Pennsylvania and before the U.S. Patent and Trademark Office. Active in his community, Don is a certified youth soccer referee, retired volunteer coach, and general counsel board member for a local sports association. Outside of work, he enjoys spending time with his wife and two children.
