What Employers Need to Know about I-9 Compliance

Every employer (even those with only a single employee) must properly complete and maintain I-9s for all employees. Despite its appearance as a “simple form,” accurately completing I-9s can be challenging. Even employers with the best of intentions and a desire to be legally compliant typically make a fair number of errors when completing I-9s. Failure to maintain I-9 compliance, including even basic unintentional errors when completing the I-9 form, can result in substantial fines. By keeping current with best practices and conducting periodic internal auditing, employers can elevate I-9 compliance and reduce the risk of an unfavorable government audit and resulting fines. This session will provide an overview of and practical guidance regarding when I-9s must be completed, how to properly complete and maintain I-9s, which documents are acceptable to confirm employee identify and work eligibility for I-9 purposes, when to purge/destroy I-9s pertaining to former employees, and how to conduct periodic internal I-9 audits and correct errors.
