Fair Labor Standards Act (FLSA): Overview and the New Overtime Exemption Regulations

In May, the U.S. Department of Labor (DOL) issued new final regulations for the FLSA’s “white-collar” overtime exemptions. These regulations take effect December 1, 2016, and present the most significant changes to the wage and hour laws in decades. The DOL estimates that the changes contained in the new regulations will result in a $12 billion increase in employee wages over the next 10 years and make 4.2 million currently exempt employees non-exempt and now eligible for overtime pay. This briefing will provide an overview of the FLSA and address how the overtime exemption requirements will change as a result of the new regulations and strategies for employers to consider to maintain compliance when the regulations take effect. FLSA coverage and how the new regulations will impact employers in the non-profit sector will also be discussed. Be prepared: Ignoring the new regulations will expose employers to significant risks and substantial potential liabilities.
